Liability Waiver & Terms of Participation
for your personal GAC AION Experience Drive
As the driver, by giving my consent I confirm that I am over 18 years of age on the day of the Experience Drive and hold a valid Category B driving licence recognised in Austria. In the event of a claim, the insurance company is entitled to verify the information I have provided. As an accompanying person, I confirm that I will not drive the vehicle myself and agree to the further terms and conditions.
I acknowledge that the vehicle provided is driven or used entirely at my own risk and with the awareness that the use of motor vehicles involves certain risks. Participation is voluntary and takes place at my own risk and responsibility.
I release Colmobil GmbH, all parties involved, as well as the agencies and cooperation partners commissioned with the organisation of the event, from any liability for personal injury or property damage to the extent permitted by law.
I acknowledge the following conditions:

The test vehicle is a non-smoking vehicle.

In the event of demonstrably negligent or grossly negligent conduct, driving under the influence of alcohol or drugs, or damage caused by cargo, I shall be fully liable for the test vehicle in all cases. In any case, I shall be liable for the applicable deductible in accordance with the insurance policy.

In the event of fines imposed by the police as a result of violations of applicable laws (e.g. the Austrian Motor Vehicles Act or Road Traffic Regulations), I shall be liable for such fines in accordance with the statutory provisions. Colmobil GmbH is obliged to provide information to the investigating authorities where required and to identify me by name as the driver.

I shall indemnify and hold Colmobil GmbH harmless against any claims for damages made by third parties as a result of an incident caused by me.
The place of jurisdiction for any legal dispute arising from the provision of our vehicle for the purpose of a test drive shall be Vienna for all parties.
By registering, I acknowledge the following privacy information:
Colmobil GmbH, Office Park 4, Unit A.26, 1300 Vienna Airport, collects the personal data you provide in connection with the Experience Drive in order to fulfil legal obligations, in particular information obligations towards public authorities or the motor vehicle insurance provider in the event of a claim. The processing and, where applicable, transfer of this data is based in particular on Article 6 of the GDPR.
The data will be deleted as soon as it is no longer required for the purposes stated above. We store your personal data for 12 months or for as long as we are legally required to do so, for example due to statutory retention obligations or limitation periods for potential legal claims that have not yet expired.

Photo and Media Rights
I agree that Colmobil GmbH and commissioned agencies may create photographs, audio recordings, video recordings and similar material of the event and of me as a participant.
I grant the unrestricted right to use the recordings, whether in their original or edited form, worldwide, for an unlimited period of time, for all legally permissible purposes and without separate remuneration, including the right to reproduce, publish and otherwise use such recordings.
Until revoked, I hereby transfer all rights, including rights of use, exploitation and editing, to the organiser Colmobil GmbH and, in this context, waive my right to my own image as well as the assertion of any personal rights arising therefrom.
